It's really not simple, Cecil. In fact, it's not even close to being
that simple.
Like most librarys and archives, the Society doesn't own the copyright
or the trademark to the material it owns. Copyright and trademark
reside in the author or the company for whom the author worked, but in
this case, the Society has written permission to use them. Think about
a library which has a best seller on the shelves. The public owns the
copy, but obviously that doesn't make the book public domain. In fact,
the Society had negotiate with Case to print T-Shirts for sale during
the poster display some years ago, since Case owns the trademarks,
which esentially don't expire like copyrights. And there are plenty of
images on the site that are still in copyright. Do you really want to
wait 50 years for the copyright to expire before you can see the
images?
In some instances, the Society doesn't own the only version in
existance- catalog covers, for instance. However, the Society has put
in the time and effort to scan them, retouch them in some instances,
and mount them. The tag is a way of protecting the Society's efforts.
The problem with copyright is that you have to enforce it. That takes
lawyers, and quite frankly, the Society, and the State of Wisconsin,
simply doesn't have the resources. There have been instances of piracy
involving IH materials coming from the archives, and enforcement
resources were a major issue.
I have already seen instances where the images currently going up are
being used in a format where your copyright C simply would not be
visable, but the tag is. Thumbnails are a great example- I've seen
them pop up on other sites within hours of the Society's images going
up.
The Society is in pretty desperate straghts. The public, through the
legislature, is telling the Society to raise it's own funds. In fact,
legislators have proposed charging attendence fees to the library and
archives, which have been open to the public free for over 150 years.
These same legislators have been trying to get the society to charge
admission to the website itself. Putting up with that banner is in
fact a small price to pay, if it prevents even more nasty ways of
generating revenue, or the closing of the archives altogether, which
is a possibility that has been mentioned.
