I agree with Carl. However, with no video all you have is the
left front damage to Dean's truck and the right side of the other
one. It is amazing in court how things bite you in the ass. I
ended up losing $2000 on repair of a horse trailer when I went to
court. The owner of the trailer claimed I did not fix the lights
when the problem was in her truck which I never had.. Without
video it comes down to testimony...

Can’t help with the dash cam question, however, I had a
similar issue with a driver who hit my daughter head on. Claimed
he had to swerve into oncoming traffic to avoid rear ending the
car in front of him. He provided insurance papers to the Sheriff
Deputy who took the report. Contacted our insurance and they
handled everything. Then I got a letter from them that said my
deductible would have to be paid because his insurance rejected
the claim, and I would have to go after him in small claims
court if I wanted him to reimburse me. Filed the case and went
to court. He was found guilty and ordered to pay or provide
proof of insurance. He provided an insurance certificate for the
car, but it was in another person’s name. Called his insurance
company, provided all the information on the certificate, and
was told his car was not covered under that policy. Apparently a
fake insurance certificate. Back to court. Found guilty again
and ordered to pay. He was allowed to agree to monthly payments,
which I accepted as long as we got the money. Two months later
no payments. To court again. This time his wages were garnished
(I knew where he worked since it was in the sheriff’s report).
Wound up costing him more since he also pay all the court costs.

If he has a criminal record, he may be on probation and the
local police should have an address for him. Ask if they can
help you there. Also, the state should have an address if he has
a legal license. Don’t know if you can file in small claims in
Washington like I did, but you should look into it. No reason
why it should cost you anything. You were on the main road and
had the right of way. You didn’t hit him, he backed into you out
of the driveway. If he has insurance, any injuries he has should
be covered by his insurance. If he tries to claim injury, he’s
going to have to explain why the injuries aren’t covered by his
insurance. Also if he has insurance, why hasn’t his insurance
paid for his repairs?

to change the subject but I have a little challenge
right now. My antique Tractor puller P/U and I were
in a little fender bender incident recently which
has become very complex since the other driver gave
me all false data as to who he was, where he lived,
how to contact him and whether he was insured or
not. Other than that things are going well. After
about 5 days of online investigation my wife and I
tracked him down and have a working cell phone
number for him. I’ve talked to him and we have
exchanged several text messages but I still don’t
know where he lives and who his insurance company
is. I gave him my insurance company verbally at the
accident but he seems to have forgotten it and now
repeatedly asks for who the company is. I refuse to
give it to him until I get a valid insurance company
name from him. All he will talk about is getting
his truck fixed. And that the accident was my
fault. To add more stupid stuff to this whole fiasco
he is now claiming injury which is a crock of cow
dung.

He
backed out of a blind driveway onto the road heading
in the same direction as I was. This was at about
9:45PM and it was pitch black dark with no street
lights way out in the country. I only noticed the
reflection of my headlights off of the side of his
black Dodge Pick Up. No tail lights, no back up
lights, no brake lights, no running lights, no
lights of any sort. I immediately slammed on the
brakes and started steering and braking to the right
of his truck which was now close to being in the
right orientation to head down the road. I saw the
eye of a needle to try to get between the truck and
the trees at the driveway exit. Well, I came to a
stop right after brushing the side of his truck and
messing up my left fender. I got close to threading
the needle. Could have been a pretty violent
rear-ender otherwise. But as you might expect he
is now blaming me and I hit him therefore I am at
fault. I have no witnesses to prove what happened.
I’ve informed my insurance Co and filed a collision
report with the Washington State Patrol. I’m pretty
sure he is an uninsured driver which is illegal in
our state. In my investigation tracking him down I
have been told he is involved in illicit drugs and
he DOES have a criminal record.. So…. Due to this I
am looking for a dash camera to mount on our
vehicles so I don’t have to go through this
situation of not having proof again.

had one recommended to me and that is a Rove 4 but I
