[AT] Off Topic, Neighbors Tree Fell on my Property

Ash is wonderful wood but there isn't much of it left around here. If you
have some that is straight grained and sound saw it up for handles. It's
too valuable to burn now.

Watch it with the ash, Will. As the Emerald Ash Borer infestation spreads,
the wood becomes a problem. It is now quarantined in our area and cannot be
transported across county lines.

Yes, sounds like at least half is my tree if I want it. Just wanted to know
my rights. I'm going to be neighborly and give him a chance to take to his
side.

I had an Ash fall onto his property last year and I pulled it back over with
my D17. I don't think he even knew it had fallen over.... Ash is one tree
that I'm not going to lose without a fight! Boy, it sure burns nice. Burned
some last night... Always amazing stuff, burns hot, burns long, smells good,
little waste when its done.

Thanks,

Regards,

Will

Will, as I understand it, at least here in NC, a tree falling is an "act of
God" and unless the trees were in bad shape and you had notified
the neighboring tree owner of the danger then what falls on your side of the
line is your responsibility. Just cut them off at the property line
and haul them on down to your lot and you should be ok.

Hello,

Two of my neighbors hickories fell onto my walking path. I've got 10+ acres
and he has about 15 acres. Never met the neighbor since he bought the
property a few years back.

The trees fell halfway on his property and all of the tops are on my
property and walking path.

My plan is to go to his door and ask him if he wants the trees. If yes, then
I'll request that he takes them off my property at some point, tops and all.
If not, then I'll ask if I can cut them off the root ball and tow the
sections down to my splitting area.

What is the law on trees that fall onto your property? Who owns them?

This is a heavily wooded area. My feeling is that if I clear off my path I
should get the wood... Problem is, I don't really want the tops, If I'm
going to take the effort to cut up the tree I'll want the whole thing.

Any thoughts?

Regards,

Will, SE PA.
