Yes it doesn't have the 4th gear some of them like mine were built  without 4 
gear. It does have all the things that make you think it there like  the 4 on 
the shifter cover and the indent when you shift it in but nothing  happens it 
just sit there. I don't know the reason why but Case built some like  this 
and some with the 4th gear. My 1948 has the 4th gear. I have to say at  times 
when on the road going to a neighbor place over the hill I wish it did  have 4th 
gear.
